Gay sex legalized in India

‘Gay’reat day for the gay men who have been fighting for justice and the judgment by Delhi High Court is said to be progressive by the LGBT activists. With this judgment, India becomes the 127th country to legalize gay sex.

The Delhi High Court on Thursday gave a landmark judgment which allows consensual sex act between adults (don’t read straight….read gays and lesbians). As soon as the HC judgment came out, gay activists across the country celebrated. They now believe they are in the 21st century and that they cannot be labeled criminals. Gay activists also believe that the judgment would allow more people to come out of their closets.

While Bollywood cheers HC judgment, religious leaders express concern and disapprove the judgment.

In a country where public display of affection between opposite sex itself is not received well, the Delhi High Court judgment on lifting the ban on gay sex is sure to spurt serious opposition.

The judgment says that IPC, section 377 (criminalizing homosexuality) is violative of the people’s fundamental rights. The Delhi High Court bench also took the data given by NACO before giving their landmark judgment. The homosexuals are a high risk group for HIV infections and by legalizing gay sex the court believed HIV infection amongst those communities will reduce.

The judgment comes eight years after the petition was filed and the gay community, which contribute 0.3% of the Indian population are rejoicing and celebrating the moment!
